Techxhub DMCC, as Authorized Distributor for Fanatec, provides consumers with a limited warranty that all Fanatec branded products ("Products"/ "Product") purchased directly from Techxhub DMCC or its authorized retailers/resellers are free from defects in material and workmanship under normal use for a period of up to three (3) years from the original date of retail purchase ("Warranty Period").
To claim the limited warranty, customers may register the product with Techxhub DMCC using the on-line registration at www.techxhub.com/support/warranty-registration. For warranty service on covered defects during the warranty period, you can contact Techxhub DMCC at Fanatec_Support@techxhub.com. Prior to providing warranty service, Techxhub may require you to ensure product registration is completed, and provide proof of purchase details, including but not limited to a receipt or sales invoice.
This warranty applies to products purchased by end-user consumers for their own non-commercial use only. In case of products purchased for commercial use, for example Sim-Racing zones, Activations & Events Simulators, Tournament Set-Ups, and other commercial applications, the applicable warranty provisions will be as per the specific terms negotiated within the sales or maintenance contracts on a case-to-case basis.
If the Product is not operating in accordance with its published technical specification, in accordance with the limited warranty terms set out herein, at the sole discretion of Techxhub DMCC, the Product will be repaired or replaced for free or replaced with a product of an equivalent item of similar function and value, including a successor model if the original is unavailable. Equivalency shall be determined at the sole discretion of Techxhub DMCC.
Any repaired or replaced Product will be warranted for the remainder of the original warranty period or 30 days whichever is greater, or the period of time required by local statute.
Warranty coverage applies to individual Products within a bundle. In the event of a Product failure, only the defective Product will be eligible for repair or replacement. Full bundle replacement is excluded.
This limited warranty excludes counterfeit Products as solely determined by Techxhub DMCC. Any Product identified as counterfeit will not be returned and may be reported to the relevant authorities for investigation. Except where prohibited by law, all implied warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose, are hereby disclaimed. In jurisdictions where implied warranties cannot be excluded or limited, such warranties are limited to the duration of the Warranty Period.
This limited warranty does not cover: (a) damage resulting from misuse, abuse, neglect, improper installation, or unauthorized modifications; (b) cosmetic imperfections such as scratches, dents, or discoloration that do not affect functionality; (c) normal wear and tear or consumable components, including batteries or cables, unless failure results from a defect in materials or workmanship; (d) damage caused by third-party products or accessories not approved by Techxhub DMCC; (e) Products with altered, removed, or unreadable serial numbers; or (f) service performed by anyone not authorized by Techxhub DMCC.
All repairs, including any replacement of internal components, are performed exclusively by Techxhub DMCC or its authorized service provider during the warranty period. Customers should not attempt to disassemble or repair products on their own, as doing so may result in safety risks and void the warranty.
Techxhub DMCC shall have no obligation under the Limited Warranties if:
If the defects are of such type and nature as to be covered by the Limited Warranties, Techxhub DMCC shall, at its option and in its sole discretion, either: (a) accept return of the defective Products and furnish replacement Products; (b) furnish replacement parts for the defective Products; (c) repair the defective Products; or (d) accept return of the defective Products and return payments made, or issue credits for such defective Products.
If Techxhub DMCC determines that any warranty claim is not, in fact, covered by the Limited Warranties, Customer shall pay Techxhub DMCC its then customary charges for any additional required service or products.
Products manufactured by a third party ("Third Party Product") may constitute, contain, be contained in, incorporated into, attached to, or packaged together with the Products. Third Party Products are not covered by the Limited Warranties in Section 8(a) of this Distribution Agreement.
For the avoidance of doubt, TECHXHUB DMCC MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY THIRD PARTY PRODUCT, INCLUDING ANY (a) WARRANTY OF MERCHANTABILITY; (b) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (c) WARRANTY OF TITLE; OR (d) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. With respect to any Third Party Product, the warranty, if any, is provided solely through the manufacturer of such Third Party Product, the terms of which vary from manufacturer to manufacturer and Techxhub DMCC assumes no responsibility on their behalf. For Third Party Products, specific warranty terms may be obtained from the manufacturer's warranty statement.
EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, AND TO THE EXTENT PERMITTED BY LAW TECHXHUB DMCC MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS AND SERVICES, INCLUDING WITHOUT LIMITATION ANY (a) WARRANTY OF MERCHANTABILITY; (b) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (c) WARRANTY OF TITLE; OR (d) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. TO THE EXTENT THAT THE LIMITED WARRANTIES AND OR ANY PART OF IT IS INCONSISTENT WITH LOCAL LAW, THE LIMITED WARRANTIES OR THE CORRESPONDING PART SHALL BE DEEMED MODIFIED TO BE CONSISTENT WITH SUCH LOCAL LAW.
THIS WARRANTY IS EXCLUSIVE. THE LIMITED WARRANTIES SET FORTH HEREWITH AS MENTIONED ABOVE ARE THE SOLE AND EXCLUSIVE OBLIGATION OF TECHXHUB DMCC WITH RESPECT TO THE PRODUCTS. TECHXHUB DMCC SHALL NOT HAVE ANY OTHER OBLIGATION WITH RESPECT TO THE PRODUCTS, OR ANY PART THEREOF, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. THE REMEDIES SET FORTH HEREWITH SHALL BE THE CUSTOMERS' SOLE AND EXCLUSIVE REMEDY AND TECHXHUB DMCC'S ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTIES.
